1. Who we are
FitNFaith ("we", "us", "our") provides the FitNFaith service (the "Service"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms & Conditions and form a binding contract with us.
2. Acceptance
Your continued use of the Service constitutes acceptance of these terms and any future updates. If you do not agree, you must stop using the Service. You must be of legal age in your jurisdiction (or have a parent/guardian's consent) and, if using on behalf of an organization, have authority to bind it.
3. The Service
FitNFaith provides AI-generated training plans, nutrition guidance, progress tracking, scripture pairings, and related faith + fitness coaching tools. Features and availability may change at our discretion.
4. Acceptable use
You agree not to misuse the Service, including (but not limited to): unlawful activity, fraud or spam, infringing intellectual-property rights, interfering with the security or integrity of the Service (malware, probing, scraping), reverse-engineering, reselling or redistributing the Service, or circumventing technical limits. You are responsible for the confidentiality of your account credentials and all activity under your account, and you must provide accurate information and keep it updated.
5. Intellectual property
We retain all right, title, and interest in the Service, including software, documentation, AI models, branding, and content we create. We grant you a limited, non-exclusive, non-transferable license to use the Service within your selected plan. You retain ownership of the content you submit; you grant us a limited license to host and process it solely to provide the Service.
6. Service level & warranties
The Service is provided "as is". We do not warrant that it will be uninterrupted, error-free, or meet your specific requirements. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
7. Health & safety disclaimer
FitNFaith provides general fitness guidance and is not medical advice. Always consult a qualified healthcare professional before starting a new program — especially if you are pregnant, postpartum, recovering from surgery, injured, or managing a medical condition. Stop immediately if you feel chest pain, dizziness, sharp pain, shortness of breath, or any unusual symptom.
8. Payments, subscriptions & taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing cadence, applicable taxes, currency conversion, renewals, cancellations, and refunds are governed by Paddle's Buyer Terms and our Cancellation & Refund Policy. Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time; you will not be charged at renewal and you keep access until the end of the cycle you've already paid for.
9. Suspension & termination
We may suspend or terminate your access for: material breach of these terms, non-payment, security or fraud risk, or repeated/serious policy violations. On termination, your right to use the Service ends; you may request export of your personal data within a reasonable window before deletion.
10. Limitation of liability
To the fullest extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the fees you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, consequential, special, incidental, or punitive damages, including loss of profits, data, or goodwill. Nothing in these terms limits liability for fraud, death, or personal injury caused by our negligence where such limitation is prohibited by law.
11. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your content, unlawful use of the Service, or breach of these terms.
12. AI-generated content
The Service uses AI to generate plans, meal ideas, and other outputs. Outputs may be inaccurate or incomplete and are not a substitute for qualified professional advice (medical, nutritional, legal, etc.). You are responsible for your prompts, how you use outputs, verifying accuracy, and having the rights to any content you submit. We may moderate, filter, or refuse outputs, and may suspend accounts for prohibited use (illegal content, harassment, deepfakes, malware, jailbreaking, or rights infringement). Repeated infringement may result in termination.
13. Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Delaware, unless otherwise required by applicable consumer-protection law.
14. Changes
We may update these terms from time to time. Material changes will be announced in-app or by email. Continued use after changes take effect constitutes acceptance.
